Welcome to Homeosetu. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the websites, online study courses, cloud-based software applications (including progressive web applications), and mobile applications (collectively, the "Services" or "Platform") owned and operated by Homeosetu Software LLP ("Company", "we", "us", or "our").

By creating an account, purchasing a course, subscribing to our software, or accessing our mobile app, you ("User", "Learner", "Practitioner", or "You") agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Platform.

1. Scope of Services & Account Eligibility

1.1 General Access

To use our Platform or purchase courses, you must be at least 18 years of age (or the legal age of majority in your jurisdiction). Account registration and authentication are secured through our third-party provider, Clerk. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

1.2 Restricted Mobile App Access (Homeopathic Practitioners Only)

Our mobile application is designed exclusively for verified Homeopathic Doctors, Practitioners, and qualified medical students.

  • We reserve the right to require proof of identity, degree qualifications, or medical registration numbers prior to or following granting mobile app access.
  • Homeosetu reserves the absolute right to suspend or terminate app access if professional credentials cannot be verified or are found to be fraudulent.

1.3 Account Non-Transferability & Anti-Sharing

Your account, course enrollments, and software subscriptions are strictly personal to you. You may not share, sell, rent, or transfer your account login details to any third party. Multi-user access under a single account is strictly prohibited and will result in immediate account termination without refund.

2. Intellectual Property Rights & Software License

2.1 Ownership

All content on the Platform—including video lectures, clinical course materials, proprietary repertories, software interface designs, databases, graphics, code, and AI assistant tools—is the exclusive intellectual property of Homeosetu Software LLP or its content creators and is protected by copyright and intellectual property laws.

2.2 Limited License

Subject to your compliance with these Terms and payment of applicable fees, Homeosetu grants you a limited, non-exclusive, non-transferable, revocable license to access and use our study courses and cloud-based software for your personal educational and clinical practice use.

2.3 User Restrictions

You expressly agree that you will NOT:

  • Copy, modify, duplicate, distribute, sell, or create derivative works from any part of our Platform or course content;
  • Decompile, reverse engineer, disassemble, or attempt to extract the source code of our cloud software or mobile app;
  • Use automated bots, scrapers, web crawlers, or data extraction tools to gather platform data, repertory text, or course materials;
  • Attempt to bypass or compromise security features, authentication measures (Clerk), or software subscription access controls; or
  • Misuse the cloud software's AI Assistant to generate spam, automated medical advice for third parties, or malicious content.

3. Medical & Clinical Disclaimer

3.1 Educational & Decision-Support Tool Only

All content, study courses, repertory tools, search engines, and AI-assisted clinical tools provided on Homeosetu are designed strictly for educational, informational, and clinical reference purposes for trained practitioners.

3.2 Practitioner Responsibility

  • Homeosetu does NOT provide personalized direct patient medical treatment, diagnoses, or prescriptions.
  • Software algorithms, repertory suggestions, and AI insights are decision-support aids only. They do not replace individual clinical evaluation or certified medical judgment.
  • The licensed practitioner assumes 100% final clinical responsibility for any remedy selection, potency determination, patient diagnosis, or treatment plan executed in their private practice.

4. Fees, Payments, and Taxes

4.1 Payment Gateway

All online payments for courses, software subscriptions, and digital access are processed securely through PCI-DSS compliant payment gateways (such as Razorpay). Homeosetu does not collect or store full credit/debit card numbers or bank account passwords on its servers.

4.2 Taxes & Pricing

All prices listed on the Platform are subject to applicable taxes, including Goods and Services Tax (GST) in India, which will be calculated and displayed during checkout.

4.3 Refund Policy

All sales, course enrollments, and software subscriptions are subject to our Return and Refund Policy. Purchases are generally non-refundable once access to cloud content or software features has been granted, except as explicitly stated in our posted Refund Policy.

5. Acceptable Code of Conduct

When interacting with our Platform, public forums, or community discussions, you agree not to post, upload, or transmit any content that is:

  • Defamatory, abusive, harassing, threatening, or hateful;
  • False, misleading, or impersonating another practitioner or user;
  • Containing software viruses, malware, or harmful technical scripts; or
  • Infringing upon the intellectual property rights or privacy of others.

Homeosetu reserves the right to remove any violating content and suspend non-compliant user accounts immediately.

6. Limitation of Liability & Indemnification

6.1 Service Availability ("As-Is")

Our cloud software and online services are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to maintain uninterrupted 24/7 access, Homeosetu does not guarantee that the cloud platform, servers, or mobile application will always be error-free, uninterrupted, or immune to temporary technical outages.

6.2 Liability Cap

To the maximum extent permitted by applicable law, Homeosetu Software LLP, its partners, directors, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of (or inability to use) our courses, cloud software, or mobile app.

6.3 Indemnification

You agree to indemnify, defend, and hold harmless Homeosetu Software LLP against any claims, losses, liabilities, or legal fees resulting from your violation of these Terms, misuse of our software, or clinical decisions made in your medical practice.

7. Termination

We reserve the right to suspend or terminate your account and access to our Platform at our sole discretion, without prior notice, if:

  • You breach any provision of these Terms or Privacy Policy;
  • We suspect fraudulent, abusive, or unauthorized account sharing; or
  • You fail to verify your medical credentials for practitioner-restricted platforms.

Upon termination, your right to use our cloud software and view enrolled courses will cease immediately.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai / Palghar District, Maharashtra, India.

9. Changes to Terms

Homeosetu Software LLP reserves the right to modify or replace these Terms at any time. Updated versions will be posted on this page with a revised "Last Updated" date. Continued use of our Platform following any updates constitutes acceptance of the new Terms.
